Terms of Service

Welcome to AiKi. These Terms of Service ("Terms") govern your access to and use of the AiKi mobile application (the "App") provided by Emotion Tech ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

AiKi is an AI-powered flashcard application designed to help you memorize and learn efficiently. The App provides features including but not limited to: creating and managing flashcard decks, AI-driven content generation and tutoring via chat, spaced repetition study sessions, study activity tracking, and global leaderboards. The App is available on both the Apple App Store and Google Play Store.

2. User Accounts

To access certain features, you must create an account by signing in with Google Sign-In or Apple Sign-In. You are responsible for:

• Maintaining the security of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

3. Subscriptions & Payments

3.1 AiKi Pro

AiKi offers a premium subscription called "AiKi Pro" available as Monthly and Annual plans. AiKi Pro unlocks unlimited access to AI features, including unlimited AI Chat messages and AI deck generation, while free users are subject to daily usage limits.

3.2 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. By subscribing, you agree to the payment terms of the respective store. We do not directly process or store your payment information.

3.3 Auto-Renewal & Cancellation

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Cancellation can be managed through your device's subscription settings (Apple App Store or Google Play Store). No refunds will be provided for partial billing periods.

3.4 Free Tier

AiKi provides core features for free with daily usage limits on AI-powered functionalities. Free users may create flashcards, study, and access basic features without a subscription.

4. AI-Generated Content

The App uses artificial intelligence (powered by Google's Gemini models via Firebase AI) to generate flashcard content, provide study suggestions, and engage in educational conversations. Please be aware that:

You retain ownership of all content you create within the App, including flashcards, decks, and study materials. By using the App, you grant us a limited, non-exclusive license to store and process your content solely for the purpose of providing and improving the Service.

You are solely responsible for the content you create. You agree not to create content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Use automated scripts, bots, or scrapers to access the App.
• Attempt to gain unauthorized access to other users' accounts or data.
• Manipulate leaderboard rankings through fraudulent activity.
• Circumvent subscription restrictions or usage limits through technical means.

7. Intellectual Property

The App, including its design, code, graphics, logos, and all related intellectual property, is owned by Emotion Tech and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Emotion Tech and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the App — regardless of the theory of liability. Our total liability shall not exceed the amount you paid for the App's subscription services in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice. You may terminate your account at any time by using the "Delete Account" option in the App's Profile settings.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved in the competent courts of Vietnam.

12. Changes to These Terms

We may revise these Terms at any time by updating this page. We will notify you of significant changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
